Tribute to mediocrity, or less...


Sandra Day O'Connor is finished. Sam Alito will soon be taking her seat. O'Connor was not a good Justice, but she wasn't a bad Justice. A great deal of her decisions made absolutely no sense. For example:

McConnell v. FEC: McCain-Feingold (though troubling) was for the most part Constitutional? Judicial review isn't line item!

Lawrence v. Texas: Who knew that State law that is not contrary to the Constitution could be struck down because of a flawed (progressive) interpretation of the Fourteenth Amendment?

Also...

Justice O'Connor was a firm believer of "transjudicialism" which is a threat to our Republic. Transjudicialism relies (somewhat) upon international law when deciding cases. It is absolutely an absurd philosophy which must be rejected.

Judicial decisions should not be based on foreign law. Anyone who believes otherwise should most definitely not serve in any capacity in our government.

McCain-Feingold Unconstitutional


“Chief Justice John Roberts expressed doubts Tuesday about legal restrictions on political ads by outside groups as the Supreme Court took up a new challenge to the McCain-Feingold campaign finance law.”

I understand that this case has small differences to the case in 2003 where the law was upheld by a 5-4 vote. That case was about the first amendment. This case is about specific technicalities involved with McCain-Feingold. Some believe it’s the same rehashed news from 2003. It’s not. McCain-Feingold will be ruled unconstitutional after Judge Alito is confirmed. I would bet on it.

What part of “Congress shall make no law” do they not understand? Not only is our right to freedom of speech in the U.S. Constitution, but also in our State Constitutions where they should be. Every member who signed McCain-Feingold ought to resign, no matter what their service to our country, or any great thing they’ve ever done.

Doe v. Groody: The Sam Alito Code


Many of you have seen the relatively recent ad from the “Coalition for a Fair & Independent Judiciary.” The ad says that Supreme Court nominee Samuel Alito, “even voted to approve the strip search of a 10-year-old girl.”

The horror!

What some may not understand is that in the matter of Doe v. Groody this ten year old girl was at her father’s home in Pennsylvania when police came to arrest him. He was a drug dealer. They had a warrant. Doe v. Groody was not about the Constitutionality of strip searches of 10 year old girls, it was about the search warrant. The affidavit accompanying the warrant read, “The search should also include all occupants of the residence…” Alito read the warrant in context with the affidavit and said “the magistrate intended to authorize a search of all occupants of the premises.”

Alito’s colleagues disagreed with him, but nevertheless he was right. It was a technical dispute. It had nothing to do with Alito’s personal policy preference. When Judges rule in cases, it affects the outcome and process of future decisions. Judges decide cases on their merits, not on public opinion, and certainly not on how they think it may affect the future. This is a bold statement. Judges aren’t God.

The Debt...

Administration seeks to raise debt limit now capped at $8.18 trillion.

Enough is enough. The United States government needs to have a New Years Resolution to stop increasing the debt, and then begin paying it off.

What seems to be the problem?

Believe it or not the United States Government in 2005 spent $352 billion to the holders of the National Debt. NASA received $15 billion. The Department of Defense received over $500 billion, and the Department of Health and Human Services received over $600 billion. Ever since 1969 Congress has spent more money than its income. The cost of pork-barrel spending last year was $27.3 billion.

The Presidents tax cuts aren’t to blame, ever since his cuts… tax revenue has risen.

The Solution:

1) No more raising the debt ceiling after this year.
2) The President needs to veto some costly legislation.
3) Reform the tax system. Debate “Flat Tax.”
4) Reform the health care system.
5) The President needs to give an address to Congress against pork-barrel spending. Though it individually benefits the States, it hurts the Nation. No more ridiculous McCain bills.
